What is Paid Family & Medical Leave (PFML)?

The landscape of Paid Family and Medical Leave is changing as states create their own unique PFML programs. In general, PFML is job-protected paid leave that allows employees to:

  • Bond with a newborn, adopted or foster care child
  • Care for a seriously ill family member
  • Address important needs related to a family member’s military service
  • Take leave for your own serious health condition

Depending on what is allowed in each state, a state may allow PFML coverage through private insurance carriers along with the state option.

Rhode Island

Temporary Caregiver Insurance (TCI) became effective January 2014.

Washington

Paid Family & Medical Leave (PFML) benefits began January 1, 2020.

California

Paid Family Leave (PFL) Law effective since January 1, 2004.

California Paid Family Leave (PFL)

Partially paid leave to care for a seriously ill or injured child, parent, parent-in-law, grandparent, grandchild, sibling, spouse, or registered domestic partner and for parents to bond within the first year with a biological, foster or adopted child.

California PFL offers leave for exigencies related to military active duty or call to active duty of an employee’s family member.

California state disability insurance provides short-term disability insurance.

California State Disability Insurance (SDI)

SDI is comprised of Paid Family Leave (PFL) and Disability Insurance (DI).

Paid Family Leave

  • Up to 8 weeks of paid leave
  • 60-70% of pay, up to $1,698 per week for 2024

Disability Insurance

  • Up to 52 weeks of paid leave
  • 60-70% of pay, up to $1,698 per week for 2024

Colorado

Colorado Family & Medical Insurance (FAMLI)

Colorado Family & Medical Leave Insurance is expected to pay benefits starting in 2024. Colorado FAMLI allows for family leave and medical leave for an employee’s own illness, injury or disability. Employees may take family leave to bond with a new child, recover from a personal illness or injury, care for an ill or injured relative and respond to certain family military-connected events. Employees may also take safe leave to address certain needs arising from domestic violence, stalking, or sexual assault or abuse.

Colorado Benefits Overview

  • Up to 12 weeks of leave with an additional 4 weeks for pregnancy or childbirth complications.
  • Up to 90% wage replacement, up to $1,100 per week maximum

Connecticut

Paid Leave (CTPL) benefits began January 2022.

Connecticut Paid Leave (CTPL)

Connecticut benefits began January 2022. The CT law mandates employee contributions will be capped at 0.5% of their weekly wages up to the Social Security maximum. Premium is paid by the employees only; there is no financial contribution from employers. Employees may take leave for their own serious health condition, to bond with a new child or care for a family member with a serious health condition, or for a qualifying military-related circumstance. Employees may also take safe leave to address certain needs arising from domestic violence, stalking, or sexual assault or abuse.

Connecticut CTPL Benefit Overview

  • Up to 12 weeks combined family and medical leave
  • 95% of the employee’s base weekly earnings up to 40x the minimum wage
  • Employees earning more than minimum wage will receive an additional 60% of their weekly pay above minimum wage
  • The maximum benefit is based on 60x the minimum wage. 60x the minimum wage is equal to $941.40 per week

Delaware

Paid Family & Medical Leave (PFML) benefits will begin January 1, 2026.

Delaware Healthy Delaware Families Act (DE PFML)

PFML allows for paid medical leave for an employee’s own illness, injury or disability. Family leave covers parental leave for bonding, caring for a sick family member, or qualifying military exigencies. Contributions will begin on January 1, 2025.

Delaware Benefits Overview

  • For employers with 10 or more employees, up to 12 weeks of parental leave in a benefit year
  • For employers with 25 or more employees, an additional 6 weeks of family or medical leave in a 24-month period
  • Up to 80% salary replacement with a maximum benefit of $900
  • A minimum benefit of $100

A private plan is allowed under the law.

District of Columbia

Paid Family Leave (PFL) benefits began July 1, 2020.

District of Columbia Paid Family Leave (PFL)

Paid leave program funded by employers for family and medical leave that provides parental leave for bonding with a new child, family leave to care for a family member with a serious health condition and medical leave to care for the employee’s own serious health condition. The program is funded by employers only.

District of Columbia Benefits Overview

  • Up to 12 weeks for a combination of paid family and medical leave
  • Up to 12 weeks of parental leave
  • Up to 12 weeks of family leave to care for family member
  • Up to 12 weeks of medical leave
  • Up to 90% of average weekly pay with a $1,049 per week maximum
  • Up to 2 weeks of paid pre-natal leave

A private plan is not allowed under the law.

Hawaii

Hawaii Family Leave Law (HFLL) is currently in effect.

Hawaii Family Leave Law (HFLL)

HFLL up to 4 weeks of unpaid leave to workers of employers with 100 or more employees. Employees may use leave for the birth or adoption of a child or to care for a sick child, spouse, sibling or parent.

Hawaii Temporary Disability Insurance (TDI)

TDI is for an employee’s non work-related illness or injury, including recovery from pregnancy.

  • HFLL allows for up to 4 weeks of leave
  • TDI allows for up to 26 weeks of leave

Maryland

Paid Family & Medical Leave (PFML) benefits will begin January 1, 2026.

Maryland Paid Family & Medical Leave (MD PFML)

PFML allows for paid medical leave for an employee’s own illness, injury or disability. Family leave covers parental leave for bonding, caring for a sick family member, qualifying military exigencies, or caring for an injured service member. Contributions will begin on October 1, 2024.

Maryland Benefits Overview

  • Up to 12 weeks of paid leave in a benefit year
  • An additional 12 weeks of leave in the same benefit year if:
    • an employee takes bonding leave and then becomes eligible for medical leave; or
    • an employee takes medical leave and then becomes eligible for bonding leave
  • Up to 90% salary replacement with a maximum benefit of $1,000
  • A minimum benefit of $50

Massachusetts

PFML allows for paid family leave and leave for an employee’s own illness, injury or disability. Family leave is leave for a family member’s call to active duty or qualifying exigency, caring for a service member with a serious condition related to their service or caring for a family member with a serious health condition. PFML can also be used for parents to bond within the first year with a biological, foster or adopted child. The program is funded through premiums contributed by employers and employees.

Massachusetts Benefits Overview

  • Up to 26 weeks total combination of paid family and medical leave
  • Up to 12 weeks of family leave to care for a family member
  • Up to 12 weeks of family leave for bonding after birth, adoption or placement
  • Up to 12 weeks of family leave to manage affairs while a family member is on active duty
  • Up to 20 weeks of medical leave for your own serious health condition
  • Up to 26 weeks of family leave to care for a family member who was injured serving in the armed forces
  • $1,149.90 maximum benefit per week

Minnesota

Paid Family & Medical Leave (PFML) benefits begin January 1, 2026.

Minnesota Paid Family & Medical Leave (PFML)

This program will provide eligible Minnesota workers when they face life circumstances such as a serious health condition, bonding with a new child, or need to care for a loved one.

Minnesota Benefits Overview

  • Up to 20 weeks total combination of paid family and medical leave
  • Up to 12 weeks of family leave for bonding after birth, adoption or placement, to care for a family member, or safe leave
  • Up to 12 weeks of medical leave for your own serious health condition
  • Up to 90% wage replacement

New Hampshire

Paid Family & Medical Leave (PFML) benefits will begin January 1, 2023.

New Hampshire Granite State Paid Family Leave (NH PFML)

New Hampshire PFML is a voluntary benefit available to all employers and workers but required of none. Employers are not required to purchase a NH PFML Insurance Plan.

New Hampshire PFML allows for family leave and medical leave for an employee’s own illness, injury or disability. Employees may take family leave to bond with a new child, recover from a personal illness or injury, care for an ill or injured relative, and military exigency or to care for a service member with a serious injury or illness.

New Hampshire Benefits Overview

Employees can take job-protected leave:

  • For a worker’s own serious health condition when disability coverage does not apply, including childbirth
  • For a worker to bond with a child during the first year of birth, including placement for adoption or fostering
  • For a worker to care for a family member with a serious health condition
  • Any qualifying urgent demand or need arising out of the fact that the worker’s spouse, child or parent is a covered military member on covered active duty
  • For a worker to care for a covered service member with a serious injury or illness if the eligible worker is the service member’s spouse, child, parent or next of kin

Employers can choose to purchase a 6-week leave plan or a 12-week leave plan.

New Jersey

Family Leave Insurance (FLI) became effective in 2008.

New Jersey Family Leave Insurance (FLI)

New Jersey FLI allows for leave to care for children, spouse, parents, parents-in-law, siblings, grandparents, grandchildren, domestic partners, one partner in a civil union couple, any other person related by blood or any person with whom an employee shows to have the equivalent of a family relationship. It also allows for leave to cover victims of domestic or sexual violence and for bonding with a biological, foster or adopted child.

New Jersey Temporary Disability Benefits (TDB)

TDB provides for paid leave for employees who cannot work due to illness, injury or disability not related to their job.

New Jersey Benefits Overview

  • An employee receives 12 weeks of leave under FLI
  • An employee receives 85% of their average weekly wage up to a maximum of $1,055 per week
  • An employee may receive up to 26 weeks leave under TDB

New York

Paid Family Leave (PFL) benefits began January 1, 2018.

New York Paid Family Leave (PFL)

Allows for paid leave while caring for family members. A family member includes bonding with a child in the first year and caring for a spouse, domestic partner, child, stepchild, parent, stepparent, parent in-law, grandparent and grandchild. Employees may also take PFL when a spouse, domestic partner, child or parent is called to active military service or has been notified of impending deployment.

New York Disability Benefits Law (DBL)

Paid disability leave to employees when they suffer an injury or illness off-the-job.

New York Benefits Overview

  • 12 weeks of paid leave
  • 67% of employee’s weekly pay
  • Benefit maximum is $1,151.16 per week

New York DBL

  • Up to $170 per week benefit

A total of 26 weeks for New York DBL and New York PFL is allowed.

Oregon

Paid Family & Medical Leave Insurance (PFMLI) is expected to pay benefits starting September 3, 2023.

Oregon Paid Family & Medical Leave Insurance

Oregon Paid Family & Medical Leave Insurance is expected to pay benefits starting in 2023. Family leave may be taken for bonding with a new child and care of a family member with a serious health condition. Medical leave may be taken for an employee’s own serious health condition. Employees may also seek help for themselves or a dependent in domestic violence, harassment, sexual assault or stalking cases under safe leave.

Oregon Benefits Overview

  • Up to 12 weeks paid for any combination of family, medical and safe leave, with total paid and unpaid leave capped at 16 weeks (up to 2 additional paid weeks for a total of 18 weeks for women who experience certain limitations related to pregnancy or childbirth)
  • Up to 100% wage replacement

Rhode Island

Temporary Caregiver Insurance (TCI) became effective January 2014.

  • TCI allows for up to 6 weeks leave, with a maximum pay of $1,007 per week
  • TDI allows for up to 30 weeks leave, with a maximum pay of $1,007 per week

Both programs are financed by payroll deductions

Washington

  • Up to 12 weeks of family leave
  • Up to 12 weeks of personal medical leave. Two additional weeks when the leave is for incapacitation due to pregnancy complications
  • Up to 90% wage replacement, up to $1,456 per week maximum
